The Employee Retirement Income Security Act of 1974 — commonly called ERISA — is a federal law that regulates employee benefit plans, including those for dental care. Self-funded ERISA plans, which cover 46 percent of subscribers, are becoming increasingly difficult to amend as some carriers argue that ERISA, as federal law, supersedes the state insurance laws that protect patients.
